NILU AGRAWAL ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is languishing in jail since 01.01.2017 in a case registered for offences punishable under Sections 272, 273 and 308 of the Indian Penal Code and Sections 30 and 38 of Bihar Excise Amendment Act.
The prosecution case instituted on the basis of the written statement of the informant is that the petitioner was apprehended on a motorcycle and from his possession 27 liters country made liquor was recovered, accordingly, a seizure list was prepared.
It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated in the
Patna High Court Cr.Misc. No.15600 of 2017 (2) dt.12-04-2017 2/2 aforesaid case. He further submits that nothing has been recovered from his conscious possession and charge sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - XII, Siwan in connection with Nautan P.S.Case No. 195 of 2016.
