The petitioner seeks bail in connection with Patori (Mahanpur O.P) P.S. Case No. 29 of 2017, registered under Section 414/34 of the Indian Penal Code.
The accusation is that on receiving secret information about selling of the parts of the stolen motorcycle by some miscreants, Police reached at the scrap shop of Chhotu Sah (Petitioner) and Gopal Sah. On seeing the Police personnel, three persons started fleeing, but on chase petitioner and one Dilip Sharma were apprehended, who also disclosed the name of his associate as Gopal Sah, who succeeded to flee away. On search, some parts of the motorcycle was recovered, but no paper
Patna High Court Cr.Misc. No.11817 of 2017 (2) dt.19-04-2017 2/2 regarding the motorcycle parts was produced before the Police. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. Further submission is that petitioner has no criminal antecedent is in custody since 22.01.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in connection with Patori (Mohanpur O.P) P.S. Case No. 29 of 2017.
