JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-04-2017 The petitioner seeks regular bail in connection with Saurbazar P.S. Case No. 454 of 2016, registered for offences punishable under Section 395 of Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner's name has surfaced in this case only on the basis of confessional statement of co-accused and except that there is nothing against him. Petitioner has falsely been implicated in this case as he has criminal antecedent. Petitioner has been in judicial custody since 29.11.2016.

Having heard both sides, from perusal of the record, it appears that petitioner has criminal antecedents and further from

Patna High Court Cr.Misc. No.11814 of 2017 (3) dt.18-04-2017 2/2 para -20 of the case diary, it appears that one mobile has been recovered from the possession of the petitioner, considering the above facts, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
