The petitioner being the husband of the complainant is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and 4 of the Dowry Prohibition Act.
Basic accusation is of torture for non-fulfillment of dowry demand.
The notices were issued to the complainant on 23.12.2013. The office notes dated 19.01.2015 reflected that the notices were received by the father of the complainant but
Patna High Court Cr.Misc. No.40265 of 2013 (4) dt.06-02-2015 till date none had appeared on behalf of the complainant, which gives support to the contention of the petitioner as pleaded in para-7 of the petition that the complainant has performed second marriage with Chano Yadav, S/o Ramawtar Yadav.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Complaint Case No. 156 (C) of 2012, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
