2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 64 ( 2 ), 69, 316, 351 , 122 and 125 of BNS.

3 . The prosecution case in brief, is that informant namely Manta Kumari alleged that in July 2023 , she came in contact with this petitioner and thereafter, friendship developed between them and on pretext of marriage , this petitioner made physical relationship with informant and also took Rs. 9 lakh through bank account and 6 lakh in cash for the purpose of

Patna High Court CR. MISC. No.60453 of 2025(2) dt.08-09-2025 2/3 purchasing scorpio and motorcycle and when informant asked to marry her, then petitioner refused to do so and also refused to return the alleged money . Later on , informant came to know that petitioner is already a married person .

4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. Informant is a police constable and she was posted in Kendra Dehri and she is a married lady and has got one 8 years old child. As a matter of fact, there was dispute over transaction of money with regard to business, between both the parties and taking advantage of the same , this false and concocted case has been lodged against this petitioner. As soon as, money dispute ended between the parties, then informant herself filed a compromise petition in the Court of SDJM, Dehri, Rohtas on 04.08.2025 stating therein that all the dispute between both the parties has been resolved.

Learned counsel for the State as well as learned counsel for the opposite party No. 2 does not dispute the contention made on behalf of this petitioner. 6 Considering the fact that matter has already been compromised between the parties clean antecedent of the petitioner and other circumstances of the case , in the event of

No.60453 of 2025(2) dt.08-09-2025 3/3 arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM Dehri Rohtas at Sasaram in connection with Dehri ( Town) P.S. Case No. 298 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
