JUSTICE MIHIR KUMAR JHA ORAL ORDER 23-07-2015 Heard learned counsel for the parties.

Having regard to the fact that at least the matter was heard on three occasions for some sort of settlement with his wife and that settlement has failed, this Court now, when Mr. Abhya Shankar Singh, learned counsel for the petitioner submits as with regard to offer of the petitioner of paying Rs. 2,000/- per month for maintaining not only his wife, opposite party no.2 but also a daughter, out of such marriage, would at least come to a conclusion that the petitioner is only trying to avoid his responsibility as a husband.

That being so, the prayer or anticipatory bail of the

Patna High Court Cr.Misc. No.42168 of 2014 (5) dt.23-07-2015 petitioner, namely, Bipin Kumar @ Bipin Singh is hereby rejected but, then, nothing said in this order shall come in the way of the petitioner if he surrenders and makes a prayer for regular bail. The interim order passed earlier shall automatically stand vacated.
