2. The petitioner has preferred this application for grant of regular bail in connection with Mehsi P.S. Case No. 88 of 2025 registered for the offences punishable u/s 119(1), 308(2), 318(4), 352, 351(2) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and the other co-accused persons are alleged to have constructed wall at the land of the informant and locked it after fixing an Iron gate.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to land dispute. It is further submitted that no

No.59628 of 2025(2) dt.27-08-2025 2/2 incriminating article has been recovered from the conscious possession of the petitioner and he has no concern with the alleged occurrence. The petitioner has clean criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case and also considering the clean antecedent of the petitioner as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran, in connection with Mehsi P.S. Case No. 88 of 2025, with a condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.

7. The application stands allowed.
