The petitioner seeks bail in a case registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 27.07.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. The informant alleges that a theft was committed in his mobile shop and goods worth Rs. 55,000/- were stolen which included mobile of customers.
Learned counsel for the petitioner submits that the F.I.R. was against unknown, name of this petitioner transpired on account of video footage and during the course of
Patna High Court CR. MISC. No.71245 of 2021(2) dt.10-05-2022 2/3 investigation it is alleged that 14 mobile were recovered from his house. Learned counsel submits that from perusal of the seizure list at page-12 of the bail application it would manifest that six mobiles were recovered from the shop of the informant itself, thus it is submitted that the petitioner has been falsely implicated in the present case. Learned counsel submits that even presuming what has been alleged is true, without admitting for the purposes of bail, then the petitioner is a person with clean antecedent and is a young boy of 21 years of age and if he remains in custody for a long time, he may come in company of hardened criminals.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 27.07.2021, is a person with clean antecedent, chargesheet has been submitted in the case and taking into consideration the seizure-list at page-12 of the bail application, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sherghati P.S. Case No. 454 of 2021
Patna High Court CR. MISC. No.71245 of 2021(2) dt.10-05-2022 3/3 with a condition that one of the bailors of the petitioner shall be his father, Md. Abrar Alam.
