The petitioner seeks bail in connection with Nawada P.S. Case No.357/16 registered under Sections 406, 420 of the Indian Penal Code.
The allegation of the complainant/informant Sahajanand is that he has visiting term with Jag Narayan Rai and his son petitioner told about selling the house due to need of money upon which he became ready to purchase the house on payment of consideration Rs.twenty two lacs. Cheque of Rs. Two lacs and cash Rs. Five lacs were paid on 11.5.2015 to Jag Narayan Rai in presence of his wife Radhika Devi then agreement on NonJudicial Stamp was prepared. But despite several request Raj Narayan Ray neither executed sale deed executed nor returned the consideration money. Learned counsel for the petitioner submits that it would appear from the F.I.R. that negotiation was made by the father of the petitioner Jag Narayan Rai and petitioner being son cannot be fastened with such liability. The petitioner has no criminal antecedent and he is in custody since 22.12.2016. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.,Ara, bhojpur, in connection with Ara Nawada P.S.Case No.357/16.
