====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 273 of the Indian Penal Code and Section 47(A) of the Excise Act, as he is said to be the driver of a tempo, which was found abandoned and from the body of the said tempo, 885 pouches each containing 200 ml of country made liquor were recovered.

It is submitted on behalf of the petitioner that the registered owner of the tempo has already been admitted to the privilege of bail in the event of arrest by the coordinate Bench of this Court, which fact be verified by the court C.J.M., Aurangabad in connection with Amba P.S. Case No. 16 of 2015 and if that be so, petitioner above named be also given similar treatment, as his
