ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 07.07.2019 in connection with Pirbahor P.S. Case No. 366 of 2019 registered for the offence under Sections 420,274,275,276,467,468,120B of the IPC and Section 27(b),28(A),28(B),30(C) of Drugs and Cosmetic Act.

Learned counsel for the petitioner submits that on the basis of a raid the shopkeeper of a drug shop was arrested and from his conscious possession certain drugs which are said to be spurious were recovered. It is further submitted that the petitioner is also a supplier of some drugs to the said shop. But the petitioner has not supplied the drugs which had been confiscated as he had supplied Praxin 500 which is neither a prohibited nor a spurious drug.

No.55209 of 2019(2) dt.13-09-2019 2/2 Considering the aforementioned facts and circumstances and that the petitioner has clean antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Pirbahor P.S. Case No.366 of 2019.
