2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
3. 800 litres of country made liquor has been recovered from one Bolero vehicle and one person was apprehended. The apprehended person disclosed the name of this petitioner as driver of the said vehicle.
4. Learned counsel for the petitioner denies the fact that petitioner is the driver of said vehicle and submitted that the said vehicle does not belong to this petitioner. No incriminating article has been recovered from conscious possession of this petitioner. Petitioner has got no criminal antecedent as
Patna High Court CR. MISC. No.61564 of 2023(2) dt.07-10-2023 2/2 mentioned in para-3 of the bail application.
5. Having regard to the facts and circumstances of the case, let the petitioner above-named be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Exclusive Special Excise Court No. 1, Gaya in connection with Fatehpur P.S. Case No. 474 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
