The petitioner seeks bail in a case instituted for the offence under Section 302/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.02.2016. There is general and omnibus allegation against this petitioner.

The informant, who is Dafadar has stated in the written report that he got information that at 8.00 A.M. in the morning, Pradeep Yadav has been murdered by his brother. He went to the house of Pradeep Yadav and found his dead body lying in courtyard. It is further alleged that the neighbouring people were speaking that he had altercation with this petitioner for land

Patna High Court Cr.Misc. No.3710 of 2017 (2) dt.09-02-2017 2/2 dispute and on account of assault by the petitioner and other accused persons, he has died.

In this manner, it appears that mere suspicion has been raised against this petitioner. In aforesaid circumstances, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Sherghati P.S. Case No. 14 of 2016.
