The petitioner seeks bail in Bettiah Town P.S. Case No. 651/2016, registered for the offences punishable under Sections 307, 394 of the Indian Penal Code and Section 27 of the Arms Act.
The informant alleged that some unknown assaulted him on his head. On alarm his uncle came, but the accused persons fired at his leg. The accused persons wanted to snatch the bag containing money from the possession of his uncle. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. During the course of investigation, spy of the police disclosed the name of Niraj and
Patna High Court Cr.Misc. No.9936 of 2017 (3) dt.03-04-2017 four others. The spy did not disclose the name of the petitioner. Niraj confessed his guilt and disclosed the name of the petitioner, but Niraj did not disclose that the petitioner was one of the participants in the crime. It is further submitted that Discover Bike which stands in the name of the petitioner's mother was recovered from the house of the petitioner. The petitioner was not put on Test Identification Parade although; he is in jail since 24.12.2016. Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah West Champaran in connection with Bettiah Town P.S. Case No. 651/2016.
