This application has been filed for quashing the order dated 11.07.2024 passed by learned Additional District and Session Judge-XXV, Patna in connection with Criminal Revision No. 107 of 2024, whereby learned ADJ.-XXV, Patna affirmed the order dated 05.08.2022 passed by learned Additional Chief Judicial Magistrate-X, Patna in connection with Complaint Case No. 1531 (M)/2000 registered under section 34 of the Bihar Shop & Establishments Act, 1953 by which petitioner has been declared absconder and a permanent warrant of arrest has been issued against the petitioner.

3. As per prosecution, complainant inspected the

No.66505 of 2024(2) dt.23-09-2024 2/2 office premises of M/S Professional Courier, Ashok Path, Exhibition Road, Patna on 18.03.2000 and during inspection, he was said to be found that there was no compliance of certain provisions as laid down u/s 6, 12A, 33(1) of the Bihar Shop & Establishment Act, 1953 and also there is violation under rule 3(1), 12, 13, 12A & 29 of the Bihar Shops & Establishment Rules, 1955.

4. Learned counsel for the petitioner submits that the petitioner is ready to appear in the court below and cooperate in the disposal of the case.

5. In view thereof, this application is allowed.

6. In the interest of justice, the order dated 11.07.2024 passed in Complaint Case No. 1531 (M)/2000, is hereby quashed.

7. The petitioner is directed to appear in the court below and file an application under section 205 Cr.P.C. within a month.
