The petitioner seeks bail in connection with Gopalpur P.S. Case No. 177 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 29.08.2021, charge-sheet has been submitted in the case and has antecedent of five cases. Learned counsel for the petitioner submits that the allegation is of recovery of 63 litres of liquor. Learned counsel for the petitioner submits that the petitioner was arrested from the spot, is a fish trader and thus was not aware who had kept the 45 litres of liquor, out of that 63 litres, in his fish box.

Patna High Court CR. MISC. No.71776 of 2021(2) dt.28-02-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 29.08.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge-cum-Special Judge, Excise, Gopalganj in connection with Gopalpur P.S. Case No. 177 of 2021.
