The petitioner, namely, Moti Prasad apprehends his arrest in Ekma P.S. Case No.10 of 2014 under Section 7 of the E.C. Act.

The allegation is that on the hired tracker of the petitioner the L.P.G. Gas cylinders were being black-marketed by the petitioner with the driver.

The learned counsel for the petitioner submitted that the driver was arrested on the spot by the police and subsequently he has already been granted bail. The learned counsel further submitted that in fact the gas cylinders were of the consumers and the petitioner was taking to deliver the same to the respective

Patna High Court Cr.Misc. No.41841 of 2014 (2) dt.20-03-2015 consumers but in the way the police intervened. In view of the above submission of the learned counsel and the nature of allegation and that the driver has already been granted bail, I direct the petitioner to surrender before the court below within one month from today and on his so surrendering the petitioner shall be released on bail on furnishing bail bond of Rs.5,000/-(rupees five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Ekma P.S. Case No.10 of 2014.
