JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-02-2022 Learned counsel for the petitioner undertakes to remove the defects as pointed out by the Stamp Reporter within four weeks after start of normal functioning of this Court. Heard learned counsel for the petitioner and Mr. Satyendra Prasad, learned APP for the State.

This is the third attempt of the petitioner to obtain bail in connection with Mansi P.S. Case No. 194 of 2012 registered for the offences punishable under Sections 324, 326, 307, 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is in custody since 20.09.2016. He is accused in five other cases. Learned counsel for the petitioner submits that earlier the prayer for bail of the petitioner was rejected twice lastly on

Patna High Court CR. MISC. No.71380 of 2021(3) dt.16-02-2022 2/2 20.09.2021 in Cr. Misc. No. 24677 of 2019 considering the report of the learned trial court that the trial is likely to be concluded within a period of two months. It is submitted that the trial has not been concluded as yet.

In course of argument, Mr. Manoj Kumar Jha, learned counsel for the petitioner has informed this Court that now the last defence witness has remained to be examined. In that view of the matter, this Court is not inclined to release the petitioner on bail at this stage.

The trial court is expected to conclude the trial without any further delay keeping in view the earlier observations of the Court based on the report of the learned trial court.
