JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Chhatauni P.S. Case No.284 of 2016 registered for the offence under Section 30(A) of the Bihar Excise Amendment Act, 2016.

There is allegation that 700 bottles of Nepali country made liquor of 300 ml. each was recovered from the pick up Van of which the petitioner was the driver and owner. It has been submitted that the petitioner has clean antecedent. He is said to be in custody since 29.11.2016. Keeping in view the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like

Patna High Court Cr.Misc. No.8697 of 2017 (2) dt.10-03-2017 2/2 amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, in Chhatauni P.S.Case No.284 of 2016, subject to the condition that both the bailers must be close relatives of the petitioner.
