The petitioner has prayed for bail in a case registered for the offence punishable under section 7 of the Essential Commodities Act.

As per allegation in the FIR, during inspection of Vikash Seed and Fertilizer store, which was under the premiership of the petitioner,stock of fertilizer was found zero and the petitioner is engaged in black marketing of the same. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is owner of the alleged shop but run by other employee. Petitioner maintained all records regarding stock of fertilizer but without giving him opportunity of explanation, FIR

Patna High Court CR. MISC. No.62634 of 2022(2) dt.17-02-2023 2/2 has been lodged against him. No any complain has been filed against either by any farmer nor by government officials. Petitioner is languishing in judicial custody since 01.08.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Madhepura in connection with Udakishunganj P.S. Case No. 55 of 2022.
