2. The petitioner has renewed his prayer for grant of regular bail in connection with NDPS No. 55 of 2024 arising out of Industrial Area P.S. Case No. 77 of 2024 registered for the offence punishable under Sections 21(i)(a) and 22 of NDPS Act and Sections 18(c) and 27 of Drugs and Cosmetic Act which was earlier rejected by this Court vide order dated 18.03.2025 passed in Cr. Misc. No. 84492 of 2024.

3. Learned counsel for the petitioner has submitted that the raid was made on secret information and from the room constructed on the roof of this petitioner, 19 bottles of 100 ml.

Patna High Court CR. MISC. No.59504 of 2025(2) dt.22-08-2025 2/2 containing codeine phosphate and 13 Strip Nitrazepam-10 Tablets were recovered. From perusal of the seizure list, it will transpire that the seizure list does not bear the signature of the petitioner or any family member. It has also been submitted that the recovery had been made from the room of the petitioner and only allegation against him is that he managed to escape. The seizure list must contain signature of any of the inmates of the house. It has also been submitted that the petitioner is having no criminal antecedent and he is in custody since 02.08.2024.

4. The application for bail is vehemently opposed by learned APP for the State.

5. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.D.J.- 1st, Bhagalpur in connection with NDPS No. 55 of 2024 arising out of Industrial Area P.S.
