Petitioner seeks bail in a case registered for the offences punishable under Sections 18, 21, 22, 27 of the N.D.P.S. Act.

Forty small packets of Heroine like substance was recovered from the possession of the petitioner and petitioner admitted before the Authorities that the same was for personal use and sale.

Submission is that quantum of recovery is not mentioned. Hence, it cannot be ascertained that the recovered quantity was commercial quantity. Petitioner is in custody since 26.04.2019. Investigation of the case is already complete. Petitioner has got no criminal antecedent.

No.56450 of 2019(2) dt.09-09-2019 2/2 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with N.D.P.S. Case No.04 of 2019, arising out of Buxar (T) Police Station Case No.357 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
