Admittedly, none has seen petitioner committing the alleged crime and only material, which has come against the petitioner, is towel of his father which was found wrapped around the neck of the deceased.

Moreover, co-accused Joytish Mandal, having more or less similar allegation, has been granted privilege of bail by a coordinate bench of this court whereas petitioner is in jail custody since 14.12.2012.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II, Madhepura in Sessions trial no. 143/2013 arising out of Madhepura (Bharahi O.P.)P.S. Case no. 537/2012.
