The petitioner is in custody in connection with D.R.I. Case No. 5 of 2021 (NDPS No. 95/2021) under sections 20, 25 and 29 of the NDPS Act.

The prosecution as it unfolds, is/are as follows:- Upon a secret information, the police party intercepted a truck bearing registration WB-03D-0275 and Maruti Suzuki Zen Estilo bearing registration no. WB-20H1768 and recovered about 950.560 kgs of Ganja as well as 950 kgs of rice kept in 362 plastic sacks and thereafter, arrested the petitioner, who is the driver of the aforesaid truck. Thereafter, further proceeding were conduced by the authorities in presence

Patna High Court CR. MISC. No.66513 of 2023(3) dt.10-11-2023 2/2 of all the accused persons including this petitioner and Panchnama was also prepared which bears the thumb impression of the petitioner.

Earlier a report was called for on 06.10.2023 which has since been received vide letter no. 7458 of 2023 dated 16.10.2023 sent by the learned Sessions Judge cum Spl Judge, Muzuffarpur and according to which three prosecution witnesses have been examined and cross-examination of witness no. 4 (I.O./complainant) is going on.

Taking into account the aforesaid facts, this court is not inclined to extend any relief to the petitioner which is accordingly rejected.

Considering the fact that petitioner is in custody since 15.07.2021, it is expected that the trial is taken to its logical conclusion within a period of six months from today. (Rajiv Roy, J) Jagdish/SudhaU T
