The petitioner, already in custody, seeks bail in connection with Barbigha P.S.Case No. 15 of 2017 registered under Sections 147, 148, 149, 323, 324, 341, and 307 of the Indian penal Code and Section 27 of the Arms Act.
Allegation in brief is that all the accused persons, due to land dispute, came and assaulted the informant and his son and Mukesh Paswan opened fire causing fire arm injury to the informant's son.
Submission is that due to land dispute, the petitioner has been implicated in this case and there is no specific overt act alleged in the FIR rather specific allegation of shooting is against another accused Mukesh Paswan and the petitioner is in custody
Patna High Court Cr.Misc. No.11420 of 2017 (2) dt.15-03-2017 2/2 since 16.01.2017 and has no criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely Kameshwar Thakur, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Sheikhpura in connection with Barabigha P.S.
