Petitioner seeks bail in a case registered for the offences punishable under Sections 326 and 307 of the Indian Penal Code.
The petitioner is alleged to have caused injury at the neck of the son and daughter of the informant with intent to commit murder. Informant is not an eye-witness of the occurrence. Petitioner is Gotani of the informant.
Submission of the petitioner is that case diary would reveal that no eye-witness has supported the occurrence. Learned counsel for the State opposed the prayer for bail on the ground that the Doctor has found injury on the neck as alleged in the FIR.
Patna High Court Cr.Misc. No.9834 of 2017 (3) dt.11-04-2017 2/2 Considering the fact that there is no eye-witness of the occurrence and the petitioner is a female, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Chief Judicial Magistrate, Gaya/successor Court in connection with Tekari Police Station Case No. 311 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
