Mr. Avinash Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-01-2019 The writ Court vide order dated 01.04.2015 issued the following directions:
"In the aforementioned facts and circumstances, this writ application is being disposed of with a direction to the Branch Manager, Central Bank of India, Gaura Branch, District Begusarai to check up whether the said letter has been received from the District Animal Husbandry Officer or not. If the same has been received, then let him take appropriate action in the matter in accordance with law, as early as possible." Show-cause has been filed on behalf of opposite party
Patna High Court MJC No.2360 of 2015(3) dt.22-01-2019 2/3 no.8 and the following stand has been taken in para 3, 4 and 5 of the show-cause:
"3. That after the order dated 01.04.2015 passed in CWJC No.3795 of 2015 this opposite party made search of the letter dated 15.01.2015 of Animal Husbandry Officer, Begusarai, but when the same was not found out this opposite party Bank wrote letter on 07.10.2015 to the District Animal Husbandry Officer, Begusarai and in response to the same the District Animal Husbandry Officer informed that the same was sent vide letter no. 105 dated 15.01.2015 and sent the same after renewal vide letter no.2078 dated 26.10.2015, which was received on 26.10.2015.
4. That this opposite party then examined the application of petitioners sent letter dated 23.02.2016, pointing out the deficiencies in the said application informing her that the said application is thus being returned to the District Animal Husbandry Officer, Begusarai and requested her to present the application again by removing the deficiency.
5. That this opposite party once again tender unqualified apology for any inconvenience caused to this Hon'ble Court in this regard and humbly prays for pardon."
Considering the aforesaid, this Court does not find any justification to proceed any further in the matter. However,
Patna High Court MJC No.2360 of 2015(3) dt.22-01-2019 3/3 liberty shall be available to the petitioner to approach appropriate forum, if she is aggrieved by any act or omission committed by the Bank.
