JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Pusa P.S. Case No. 101 of 2016, registered under Sections 394 and 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner surfaced in the confessional statement of Gungan in para 68 of the case diary having hand of the petitioner in the present case. Thereafter, the petitioner was apprehended by the Police and Police also recorded the confessional statement of petitioner showing his involvement in the present case. Further submission is that in the present case

Patna High Court Cr.Misc. No.6496 of 2017 (3) dt.12-04-2017 2/2 petitioner is in custody since 15.10.2016, but he has not been put on TIP while informant has claimed to identify the culprits on seeing them again.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Samastipur in connection with Pusa P.S. Case No.101 of 2016.
