SINHA) Date: 13-05-2015 In the light of our order dated 11.05.2015, appellant, his parents and brother, brother of respondent are present.
2. Appellant, his parents have paid Rs. One lac in cash to the brother of respondent and in lieu of such payment, marriage between the appellant and the respondent is dissolved with their mutual consent with further direction that in lieu of such payment, entire arrears of maintenance is also adjusted.
3. It is agreed by the appellant, his brother and their parents that they shall not interfere with the proposed marriage of respondent in any manner and shall also not interfere with the affairs of the respondent in future in any manner. It is further agreed by them
Patna High Court MA No.726 of 2011 dt.13-05-2015 2/2 that they shall visit the proposed matrimonial village of respondent on 17.05.2015 and contact her proposed husband in presence of brother of respondent and clarify that there is no dispute pending between them and the respondent and that they are not opposing the proposed marriage.
4. In lieu of the aforesaid payment, the proceeding arising out of Itarhi P.S. Case No. 72 of 2004 appertaining to G.R. No. 929 of 2004 pending against the appellant and his mother in the Court of S.D.J.M., Buxar is quashed.
5. The judgment Dated 23.06.2011 passed by Principal Judge, Family Court, Buxar in Matrimonial Case No. 63 of 2005 is set aside, marriage of appellant with the sole respondent is dissolved and the appeal stands disposed of in the aforesaid terms.
6. Parties are granted liberty to bring to our notice any violation of the aforesaid terms whereafter the party violating the terms shall be taken to task by initiating contempt of Court proceeding.
