This petition under Section 482 of the Cr.P.C has been filed for quashing the order dated 01.10.2013, by which the discharge petition filed by the petitioner has been rejected by the learned S.D.J.M. Aurangabad in Tr. No. 1108 of 2013 arising out of Deo P.S. Case No. 110 of 2009/ G.R. No. 1708 of 2009. This Court has been informed that the charges have already been framed and evidence is also being led on behalf of the prosecution in this case, as such the present petition has become infructuous.

In view of the above, this application is disposed of with a liberty to the petitioner to challenge subsequent order passed
