JUSTICE SHIVAJI PANDEY ORAL ORDER 04-11-2020 On earlier occasion, the case was adjourned as learned counsel for the petitioner had not joined the proceeding. On that day, it was made clear that if on the next date, learned counsel for the petitioner would not join the proceeding, the Court will pass appropriate order on the basis of material available on record. Even today, learned counsel for the petitioner has not joined the proceeding. Hence, this Court has no other option but to dispose of the case on the basis of material available on record.

In this case, the petitioner is seeking regular bail in connection with Phulwarisharif P.S. Case No. 845 of 2018, registered for the offence under Section 304(B)/34 of the Indian Penal Code.

Allegation has been made that the present petitioner eloped with the daughter of the informant and entered into the marriage. After one year, the daughter of the informant gave birth to a child. It has further been alleged that for last one year, the petitioner and his family members used to torture the victim and also refused to give her meal. They also used to demand Rs.3,00,000/- as dowry, which was communicated by the victim to the informant. It has also been alleged that the petitioner made a call to the informant and said that her daughter is ill and admitted in H.P. Hospital, Anishabad, but after some time, he again made a call and told that they were in P.M.C.H. and after some time, again called and told that he is in Bans Ghat. When they reached Bans Ghat, they saw that the accused persons have kept the dead body for cremation. Thereafter, the informant side informed the police.

The petitioner is the husband of the deceased. From the case diary, it appears that time to time the petitioner has changed his stand; firstly he made a call to the informant and said that he daughter is ill and admitted in hospital, again informed that she has been shifted in P.M.C.H. and thereafter the deceased has been brought to the Bans Ghat.
