2. Petitioner seeks regular bail in connection with Giriyak P.S. Case No. 228 of 2025 dated 01.06.2025 registered for the offences punishable under sections 316(2), 318(4), 338, 336(3), 340(2) and 3(5) of the Bharatiya Nyaya Sanhita.
3. The main submissions advanced by petitioner's counsel are that from the bare reading of the FIR, it is clearly evident that the main allegation of cheating is against Arav Patel, in fact the said co-accused Arav Patel had been staying at Mamta Food Plaza for the past two months and the petitioner was working as a waiter in the said Food Plaza and the petitioner bonafidely followed the instructions given by coaccused Arav Patel and took the documents to the alleged place
Patna High Court CR. MISC. No.64177 of 2025(2) dt.10-09-2025 2/2 (Nanad Road) and handed over the same to the so-called victims and during that course, the petitioner himself was assaulted by the prosecution party, for which Giriyak P.S. Case No. 229/2025 was lodged, of which a copy has been filed with this petition as Annexure- 'P/2' series. It is further submitted that the petitioner bears no criminal antecedent and has been languishing in jail since 01.06.2025 and against him the investigation has been completed.
4. Though learned APP for the State has opposed the prayer of the petitioner but fairly accepts that the main allegation of cheating is against co-accused Arav Patel.

Considering the aforesaid submissions, mainly the petitioner's pleas and also taking into account his custody period and the completion of investigation against him, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Giriyak P.S.
