1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 117, 352, 351(2) and 3(5) of the B.N.S.S.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a senior citizen aged about 75 years and the informant alleges that petitioner along with his son and 5-6 unknown accused surrounded him, further petitioner was carrying sharp edged weapon and an iron rod while his son was also carrying a weapon, further he was assaulted by the accused persons by sharp edged weapon, lathi and danda causing cut injury on his nose and fracture of hand.

4. Learned counsel submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from side of the petitioner also Halsi P.S. Case No.396/2025 has been instituted against the informant and others. It is next submitted that even the allegation of assault is not specific. It is further submitted that a person was remained a person with clean antecedent all though out his life and is nearing his grave why he would indulge in such an act.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Halsi P.S. Case No.397/2024, subject to the conditions as laid down under Section 482(2) B.N.S.S.
