2. This writ petition has been filed by the petitioner seeking a direction to the respondents to constitute governing body for Patel College, Ram Briksh Nagar, Ghusian Khurd, Bikramganj, Rohtas and appoint the petitioner as Principal of the college so that the college may function smoothly.

Learned counsel for the petitioner has submitted that the petitioner is a senior most teacher of the Patel College, Ram Briksh Nagar, Ghusian Khurd, Bikramganj, Rohtas and the Principal of the college is appointed to a senior most teacher of the college on the recommendation of the governing body of the college.

On a pointed query made to the learned counsel for the petitioner as to under which Rule senior most teacher of the college is appointed as a Principal of the college on the recommendation made by the governing body, the learned counsel for the petitioner has submitted that he has not enclosed any such Rule for appointment of the petitioner as Principal of the college, as contended by him, nor has the petitioner made any pleading in the writ petition as to under which Rule the Principal of the college is appointed.

5. The petitioner, thus, has not placed on record any material to show that he has a legal right to be considered for appointment as a Principal of the Patel College, Ram Briksh Nagar, Ghusian Khurd, Bikramganj, Rohtas.

6. In that view of the matter, since the petitioner has failed to establish any legal right to be considered for appointment as Principal of the college, this writ petition is hereby dismissed being devoid of merit.
