1. Petitioner seeks regular bail in connection with Kotwali (Barari) P.S. Case No. 612 of 2023 dated 04.07.2023 registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code.
2. Heard Mrs. Vaishnavi Singh, learned counsel for the Petitioner, Mr. Ganesh Prasad Singh, learned APP for the State and perused the FIR as well as trial court's order.
3. In the facts and circumstances of this case and mainly considering petitioner's the pleas that he has been made an accused in this matter mainly on the basis of suspicion raised by the informant and as per the prosecution story, he alongwith the other co-accused persons, who are admittedly neighbour, of the informant, were seen and found standing in front of the gate of the victim's residential house which was admittedly locked from
Patna High Court CR. MISC. No.59376 of 2025(2) dt.29-08-2025 2/2 inside at that time and also taking note of the fact that while rejecting the prayer of the petitioner, the learned trial court mainly took into account petitioner's mobile communication with the deceased and also his phone's tower location near the victim's house while the petitioner is said to be neighbour of the victim and also taking note of this fact that the informant has not assigned any motive on the part of petitioner in killing the deceased, coupled with the completion of investigation against this petitioner, this court is inclined to release him on bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Kotwali (Barari) P.S.
