The petitioner seeks bail in connection with N.D.P.S. Case No. 86 of 2021, arising out of Ghorasahan (Jharokhar) P.S. Case No. 395 of 2021, registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016 and Section 20(b) (ii)(c) of N.D.P.S. Act.

As per the prosecution case, 102 kg Ganja and 180.9 litres of Nepali Kasturi Wine have been recovered from three bags which was being carried by three co-accused persons including the petitioner.

It is submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner and he has been made accused in this case only on

Patna High Court CR. MISC. No.70792 of 2021(3) dt.21-03-2022 2/2 suspicion. It is further submitted that petitioner is suffering from heart decease and his treatment is going on and he is in custody since 15.09.2021.

Learned APP for the State has opposed the bail petition and submits that more than commercial quantity of Ganja have been recovered from the possession of this petitioner.

Considering the aforesaid facts and circumstances and since more than commercial quantity of Ganja has been recovered, the bail petition of the petitioner is rejected. (Prabhat Kumar Singh, J) sanjeev/- U T
