The petitioner seeks bail in Jagdishpur P.S. Case No. 74 of 2016 initially, instituted for the offence under Sections-341, 342, 307/34 of the Indian Penal Code and later on, Section-302 of the Indian Penal Code was also added.

There is allegation in the written report that accused Laljee Singh Birendra Kumar Singh and other accused as named in the written report brutally assaulted the minor son of the informant, Himanshu Kuar after locking him in the house of the petitioner, causing serious injury to him, who subsequently died during course of treatment.

Patna High Court Cr.Misc. No.11126 of 2017 (3) dt.26-04-2017 2/2 It has been submitted that co-accused Laljee Singh has already been granted privilege of bail by a coordinate bench of this court by order dated 10-02-2017 passed in Cr. Misc. No. 54508 of 2016.

From the written report, it appears that thee is no specific allegation of overt act against this petitioner. It is alleged that other accused persons brutally assaulted the son of the informant locking him in the house of the petitioner.

In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jagdishpur P.S. Case No. 74 of 2016 to the satisfaction of learned Additional Chief Judicial MagistrateXI, Ara subject to condition that both the bailors should be close relatives of the petitioner.
