JUSTICE ARUN KUMAR ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

Petitioner, already in custody, seeks bail in connection with Chenari P.S. Case No.184 of 2016, registered under Sections 341, 385, 386/34 of the Indian Penal Code. Allegation in brief is that this petitioner was demanding Rangdari tax as the informant went over his purchased land for cultivation purpose.

Learned counsel appearing on behalf of the petitioner submits that there is a land dispute between uncle of the petitioner and the informant and the same land purchased earlier by the uncle of the petitioner was later on purchased by the informant's side, therefore, this false allegation has been levelled without any substance. The petitioner has got no criminal

Patna High Court Cr.Misc. No.11469 of 2017 (2) dt.17-03-2017 2 / 2 antecedent and has been in custody in this case since 21.12.2016 and this case was lodged after inordinate delay of one month and ten days.

Having considered the said facts and circumstances, petitioner Baban Bind is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sasaram, District Rohtas, in connection with Chenari P.S. Case No.184 of 2016.
