The petitioner seeks bail in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 23.07.2021, charge-sheet has been submitted in the case and is a person with clean antecedent. Learned counsel for the petitioner submits that the informant alleges that when he came from his dalan to his house, he saw the door of his house opened, articles were scattered and Rs. 50,000/- was missing, further alleges that his wife was lying in a pool of blood who disclosed about the occurrence and identified the petitioner as one of the accused in

Learned counsel for the petitioner submits that the injured at paragraph '26' of the case diary has given a specific statement that she was injured on account of assault by khanti made by the Ranjan Bind @ Niranjan Kumar. It is further submitted that though it is alleged in the F.I.R. by the informant that his wife was seen in an injured condition and the wife has also stated that she was assaulted by the petitioner, but there is no injury report in the case diary and further the statement of the injured was recorded after a delay of eight days. It is further submitted that the co-accused has been granted bail vide order dated 20.04.2022 passed in Cr. Misc. No. 67497 of 2021 (Ranjan Bind @ Niranjan Kumar Vs. The State of Bihar) Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 23.07.2021, is a person with clean antecedent, chargesheet has been submitted and the co-accused has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor
