Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Buxar Industrial Area P.S. Case No. 152 of 2022, dated 21.07.2022 registered for the offences punishable under Section 366(A) of the Indian Penal Code and Section 8 of POCSO Act. As per the prosecution, the informant's minor daughter aged about 15 years was kidnapped by this petitioner with the help of other accused persons named in the FIR. No.61976 of 2022(3) dt.11-04-2023 2/2 counsel are that the petitioner and the so-called victim are neighbours, in fact there was a love affair in between them and the said victim herself left her parent's house on her own free will and she is a major girl and as per medical expert's opinion her age has been assessed between 18 to 19 years at the time of medical examination and after the commission of the alleged occurrence the victim returned to her home after three days and she has recorded her statement before the Judicial Magistrate in which she has not supported the allegations of the FIR and the petitioner is a very young person and has been languishing in jail since 22.07.2022 having fair and clean antecedent. Learned APP appearing for the State has opposed the prayer for bail.

Considering the above submissions, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Buxar Industrial Area P.S.
