1. Heard learned counsel for the petitioner as well as learned APP for the State.
2. The petitioner apprehends his arrest in connection with Cyber P.S. Case no. 76/2025 registered under Sections 303(2), 318(2), 318(4), 319(2), 338, 336(2), 336(3), 340(2), 61(2), 111, 3(5) of B.N.S. and 66/66D I.T. Act.
3. The allegation in the first information is that four accused persons were apprehended by the Police for committing a cyber offence and one of the accused persons namely, Vikram Kumar, had also disclosed the name of the petitioner to be involved in the said offence.
4. Learned counsel for the petitioner submits that it would be evident from the first information report itself that four accused persons were apprehended by the Police and the

No.62770 of 2025(2) dt.15-09-2025 2/3 name of the petitioner has transpired only on the disclosure made by one of the co-accused persons, Vikram Kumar, with whose family the family of the petitioner had an inimical and strained relationship, which has subsequently resulted in a compromise dated 19.02.2025, which is Annexure-2 to the present application with Vikram Kumar and other co-accused persons. Learned counsel for the petitioner also pointed out the Annexure-3 series, which indicates land-related litigation between the petitioner's family and the family of the accused persons, and this is the reason for disclosure of the name of the petitioner by the other accused persons. It has also been submitted that the petitioner is suffering from epilepsy and is on regular medicines and treatment. The petitioner undertakes to cooperate in the case/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Taking into consideration the facts and circumstances of the case and also considering that the thrust of the allegation is against the four persons who were apprehended in this case and the disclosure of the name of this petitioner seems to be on the basis of some mala fide, let the above named petitioner who has no criminal antecedent, in the event of his

No.62770 of 2025(2) dt.15-09-2025 3/3 arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Cyber P.S. Case no. 76/2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Nawada, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023 and subject to the following conditions:- (a) One of the bailors would be a family member or close relative.
(b) The petitioner would appear before the investigating agency and cooperate in the process of investigation and in case of noncooperation, the prosecution would be at liberty to get the bail bonds of the petitioner cancelled. (Soni Shrivastava, J) krishnakant/- U T
