JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This application, for grant of anticipatory bail, arises out of Sahajitpur P.S. Case No. 66 of 2019, disclosing offences under Sections 147, 148, 149, 307 and 302 of the Indian Penal Code.

Allegation against the petitioner and others is of calling the deceased and, thereafter, the deceased was assaulted by farsa by co-accused Chandan Singh and Pintoo Singh and there is also allegation against other accused persons to assault the persons, who went to save the deceased.

Submission of learned counsel for the petitioner is that he has falsely been made accused in this case and his name transpired after one month in supervision note. Further submission is that at the time of occurrence he was at Mumbai and not at the place of occurrence.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VI, Saran, in connection with Sahajitpur P.S. Case No. 66 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
