2. The petitioner seeks bail in connection with Aurangabad Town P.S. Case No. 05 of 2022 registered for the offence under Sections 379, 411, 413 of the I.P.C.

3. The petitioner is not named in the F.I.R. and is in custody since 16.06.2025.

4. The allegation against the petitioner is of habitual dealing with stolen motorcycles and also involving in concealment of stolen property.

5. Learned counsel appearing on behalf of the petitioner submitted that the name of petitioner surfaced during investigation on the basis of confessional statement of

Patna High Court CR. MISC. No.59402 of 2025(2) dt.05-12-2025 2/3 apprehended co-accused namely, Mukesh Kumar Singh @ Buletan @ Bhuletan who has already granted bail by this Court through Cr. Misc. No. 29285 of 2022 vide order dated 14.09.2022. It is pointed out that stolen Bolero vehicle was not recovered from the possession of this petitioner. It is submitted that save and except confessional statement nothing incriminating material recovered during investigation as to connect petitioner with present crime in question. While concluding the argument, it is submitted that petitioner found involved in six more criminal cases where he is on bail and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as save and except suspicion arising out of confessional statement prima-facie nothing incriminating material surfaced during investigation as to connect petitioner with present crime in question, coupled with fact that investigation of this case already completed where petitioner

No.59402 of 2025(2) dt.05-12-2025 3/3 remains in custody since 16.06.2025, accordingly petitioner above named, is directed to be released on bail in connection with Aurangabad Town P.S. Case No. 05 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad /concerned court, subject to the conditions as mentioned under Section 480(3) of BNSS.
