The petitioners have preferred this application for grant of regular bail in a case registered under sections 20 and 21 of the NDPS.

As per the prosecution case, on a raid being conducted while one accused namely Shuzeet Kumar was arrested, one of the accused managed to escape. The arrested accused disclosed the name of the person who managed to

Patna High Court CR. MISC. No.71377 of 2021(6) dt.19-12-2022 2/2 escape as the petitioner Manjeet Kumar. Illicit liquor, smack, etc. as detailed in the FIR, was recovered from the arrested accused.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration that the petitioner Shuzeet Kumar (petitioner in Cr. Misc. no.71610 of 2021) was arrested at the spot, 62 puriyas of smack besides illicit liquor was recovered and the report of the FSL confirms the recovery of the smack, the Court is not inclined to enlarge the petitioner Shuzeet Kumar on bail and his application is rejected.

So far as petitioner Manzeet Kumar (petitioner in Cr. Misc. no.71377 of 2021) is concerned, he has not been arrested at the spot, has remained in custody for 1 year 4 months since 10.8.2021 and investigation in the case having concluded, the Court directs the petitioner Manjeet Kumar to be enlarged on bail in connection with Sonepur P.S. Case no. 450 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran.
