The instance application for regular bail has been filed by the petitioner in connection with Khagaria (Mufassil) P.S. Case No. 935 of 2021 instituted for the offence u/s 341, 302, 323, 325, 504/34 of the Indian Penal Code.
Earlier the application for regular bail of the petitioner was rejected by order dated 17.02.2023 passed in Cr. Misc. No. 58070 of 2022 with an observation that the learned Trial Court is directed to expedite the trial and conclude the trial within a period of 6 months.
In pursuance to the direction of this Court, a report with regard to the present stage of trial has been received by which it appears that the trial may be concluded within six
Patna High Court CR. MISC. No.62166 of 2023(3) dt.01-12-2023 2/2 months after framing of charge with cooperation of prosecution as well as defence.
There is no hope to conclude the trial in near future. It is submitted by learned Counsel for the petitioner that charge has been framed on 29.11.2023.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Khagaria (Mufassil) P.S. Case No. 935 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge VIII, Khagaria. (Sunil Kumar Panwar, J) Nirajkrs/- U T
