Mr.Dr. Indiwar Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-03-2023 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sessions Trial No. 193 of 2011 arising out of Phulwarisharif P.S. Case No. 1094 of 2019 registered for the offence under Sections-302, 201, 147, 149 of the Indian Penal Code.

Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that the mobile of the deceased was recovered from possession of the petitioner.

A report was called for from the trial court. It has been reported that out of six prosecution witnesses, three prosecution witnesses have already been examined and the trial is likely to be concluded within a period

Considering the nature of accusation and stage of the case, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected. The trial court is directed to take all necessary steps to expedite the trial and conclude the same as early as possible, preferably within a period of six months from the date of receipt/production of copy of this order.

The District Magistrate and the Sr. Superintendent of Police, Patna are directed to produce the prosecution witnesses on the date fixed by the trial court so that the trial could be concluded within the stipulated period of six months. Let a copy of this order be communicated to the District Magistrate and the Sr. Superintendent of Police, Patna for needful.
