The Petitioners seek bail in Triveniganj P.S. Case No. 72 of 2016 instituted for the offence under Section(s) 392 of the Indian Penal Code.
It is alleged that dacoity has been committed in the bus and 30-35 miscreants looted the articles from the passengers of the bus.
It has been submitted on behalf of the petitioners that petitioners are not named in the written report and their names have come in the confessional statement of co-accused Md. Sarfaraj Akhtar @ Guddu. The similar fact has been
Patna High Court Cr.Misc. No.4343 of 2017 (3) dt.07-03-2017 2/2 mentioned by the learned Sessions Judge in the impugned order that Md. Sarfaraj Akhtar @ Guddu confessed his guilt in para 97 of the case diary and disclosed the name of these petitioners. The petitioners are in custody since 24.10.2016. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Triveniganj P.S. Case No. 72 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioners.
