The petitioner is accused in connection with Hulasganj P.S. Case No. 75 of 2016, registered under Sections 364 and 414/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Jehanabad.

The accusation is that, in course of checking of vehicle, one Scorpio bearing registration no. BR-01PF-9089 was intercepted, in which, petitioner along with Gauri Shankar and Pankaj Kumar @ Rajnikant were apprehended and found in possession of mobile set and cash. On search, in the back side of Scorpio, Pintu Paswan and Anil Kumar were found sitting, who disclosed that they were Khalashi and Driver of the Truck and also disclosed that their Truck was looted and both were boarded

Learned counsel for the petitioner submits that petitioner has been apprehended on the spot mere on suspicion. Further submission is that prior to the present case, petitioner had no criminal antecedent but after apprehending in the present case, he has been remanded in five other cases as detailed in paragraph 3 of the petition and in the present case, he is in custody since 04.08.2016.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
