JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 506, 323, 324, 307, 379, 504/34 of the Indian Penal Code. It is alleged that for a dispute with regard to obstructing the road, the petitioner assaulted with axe on the head of the informant and when father of the informant came to rescue, he was also assaulted by the accused persons. It is also alleged that co-accused Prakash Chaudhary took out gold chain of the informant and co-accused Pankaj Chaudhary snatched wrist watch.
It is submitted by learned counsel for the petitioner that injury of the informant has been found to be simple and for the occurrence of 19.06.2015 at 1:00 P.M the F.I.R was registered on 20.06.2015 at 4:40 P.M which reached to the Court of learned C.J.M on 22.06.2015, whereas
Patna High Court Cr.Misc. No.44114 of 2015 (2) dt.29-10-2015 2/2 petitioner's side lodged Pandaul P.S. Case No. 121 of 2015 at earlier point of time on 19.06.2015 when brother and sister of the petitioner have also received injuries.
It is submitted by learned counsel for the informant that petitioner has caused incised injury on occipital region.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Pandaul P.S. Case No. 123 of 2015, pending in the Court of learned Chief Judicial Magistrate, Madhubani. With the observations above, the application stands disposed off.
