The petitioner seeks pre-arrest bail in connection with Sitamarhi P.S. Case No. 1130 of 2018 for the offences alleged under Sections 148, 324, 326, 341, 351, 389, 506, 384, 500 and 34 of the Indian Penal Code.

The accusation is that complainant/informant, Nand Kishore Prasad, used to run the grocery shop, purchasing the same to the grand-mother of the petitioner through registered sale deed on which Ravi Dhandhaniya, father of the petitioner was witness. On 10.11.2018 in the morning, petitioner, along with his father, Ravi Dhandhaniya, and mother Kanchan Dhandhaniya, came at the grocery shop and started to abuse and made demand of ransom of Rs.2,00,000/- to run the grocery shop otherwise he will be ruined. Patna High Court CR. MISC. No.61308 of 2019(2) dt.26-09-2019 2/2 the petitioner, started to abuse the complainant/informant, Nand Kishore Prasad, to dispossess from the shop. Earlier, Ravi Dhandhaniya, father of the petitioner, had lodged police case, being Sitamarhi P.S. Case No. 134 of 2018 on 09.02.2018, which was found untrue, after investigation.

The submission of the learned counsel for the petitioner is that petitioner, being the son of Ravi Dhandhaniya, has falsely been implicated in this case due to enmity and grudge. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Sitamarhi P.S. Case No. 1130 of 2018 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
